Tagradh bho ChnaG air Dreach Bile na Gàidhlig

Tha Comunn na Gàidhlig (CnaG) a’ cur fàilte air a’ chothrom freagairt a thoirt don Phàipear Comhairleachaidh air Dreach Bile Cànan na Gàidhlig agus thatar an dòchas gum bi na beachdan a leanas na chuideachadh don Riaghaltas ann a bhith a’ deasachadh ath-chunntas den Bhile, a ghabhas a-steach na beachdan aig CnaG agus luchd-freagairt eile.

Ged nach eile an ùine airson beachdachaidh air a bhith na dhuilgheadas do ChnaG, tha sinn mothachail gum faodadh saor-làithean an Dàmhair, Na Nollaig agus na Bliadhn’ Ùire a bhith air duilgheadasan adhbhrachadh do fheadhainn dhan luchd-freagairt, agus tha uallaichidhean air nochdadh gun robh an ùine beagan goirid. Bhiodh sinn an dòchas gum faigheadh neach sam bith a lùigeadh barrachd ùine freagairt gus beachdan a chur a-steach thairis air an ceann-latha de 9 Faoilleach 2004.

Bhitheamaid toilichte an cothrom fhaighinn leudachadh agus cuir ris na puingean anns an tagradh againn aig èisteachd sam bith a dhèidheadh a chumail leis a’ Chomataidh a bhios a’ sgrùdadh a’ Bhile. Tha sinn cuideachd a’ toirt cuireadh dhan Chomataidh gabhail os làimh tadhal air àitean freagarrach an Alba gus tuigse nas fheàrr fhaighinn air suidheachadh cànan agus cultar na Gàidhlig, ann an raon de dhiofaran choimhearsnachdan, air feadh Alba.

C1: A bheil e ceart gum biodh àite aig a’ Ghàidhlig mar aon de chànainean na h-Alba ann an reachdas?

Chan eil briathrachas a’ Bhile a’ toirt a-staigh molaidhean Chomunn na Gàidhlig air Inbhe Thèarainte a bha a’ moladh gum “bu chòir Achd Ghàidhlig a bhith a’ gabhail ris a’ phrionnsabal gu bheil Beurla agus Gàidhlig co-ionann ann an Alba”. Tha am prionnsabal seo a’ ciallachadh còraichean bunaiteach, shònraichte mu choinneimh seirbheisean tro mheadhan na Gàidhlig do luchd-labhairt na Gàidhlig. Bu chòir am Bile a bhith nochdadh gu soilleir gu bheil Gàidhlig na cànan oifigeil ann an Alba agus ann am prionnsabal gum bi Gàidhlig agus Beurla co-ionnan ann a bhith a’ lìbhrigeadh seirbheisean poblach. Tha sinn gu làidir den bheachd gum bu chòir briathrachas a’ Bhile a bhith air atharrachadh gu bhith a-rèir briathrachas Achd Cànan na Cuimrigh 1993. Bhiodh seo a’ ciallachadh ann an suidheachadh na Gàidhlig gum bitear a’ gabhail ris a’ phrionnsabal, cho fads a bhiodh e iomchaidh is freagarrach gu bheil a’ Ghàidhlig sa Bheurla co-ionnan.

Mur a gabhar an cothrom mìneachadh a dhèanamh air dè dha-rìribh a tha air a chiallachadh sa Bhile leis na faclan “a’ cur inbhe na Gàidhlig air stèidh thèarainte mar aon de chànain na h-Alba” bidh iomagain agus mì-chinnt a’ leantainn. Tha Ministearan air nochdadh mar thà, an dà chuid ann a Westminster agus ann an Dùn Èideann, gu bheil Gàidhlig air a bhith air aithneachadh gu h-oifigeil le Riaghaltas an dèidh Riaghaltais. Thogadh a’ phuing seo cuideachd aig an deasbad air craoladh ann an Taigh nam Morairean leis a’ Mhinistear, Lord Evans of Temple Guiting san t-Samhradh 2003. Mas e seo an suidheachadh cha bu chòir duilgheadasan sam bith a bhith ann beachdan nam Ministearan a bhith air an daingneachadh an reachdas tron Bhile gus nach èirich duilgheadasan mar a thachair le Àrd Neach Clàraidh Alba nuair a dhiùlt e do phàrant, anns a’ chiad dol-a-mach, sloinneadh a leanaibh a chlàradh anns a’ Ghàidhlig.

C2: Am bu chòir na dreuchdan air an sònrachadh ann an Earrann 1 den dreach Bhile a bhith aig Bòrd na Gàidhlig?

Bu chòir na dreuchdan a tha air an sònrachadh ann an Earrann 1 den Dreach Bhile a bhith aig Bòrd na Gàidhlig ach bu chòir beachdachadh cuideachd air feadhainn aig am bheil comas sgrìobhaidh agus leughaidh sa Ghàidhlig, a bharrachd orra-san aig am bheil comas labhairt no tuigsinn Gàidhlig. Chan eil iomradh ga thoirt air còirichean phàrantan no luchd-cleachdaidh na cànain agus bu chòir seo a bhith air a ghabhail a-staigh do dhleastanasan Bòrd na Gàidhlig.

C3: Am bu chòir na riatanasan ann an Earrannan 2 gu 3 den dreach Bhile a bhith air an cur air Bòrd na Gàidhlig?

Tha sinn ag aontachadh gum bu chòir na riatanasan ann an Earrannan 2 gu 3 den dreach Bhile a thaobh a bhith ag ullachadh Plana Nàiseanta don Ghàidhlig agus a bhith stiùireadh chùisean do bhuidhnean poblach mu Phlanadh Cànain a bhith air an cur air Bòrd na Gàidhlig. Tha mìneachadh a dhìth air a’ chlàr-ama anns am feum Bòrd na Gàidhlig am Plana Nàiseanta a chruthachadh agus a chur gu Ministearan Riaghaltas na h-Alba taobh a-staigh 12 mìos (Earrann 2). Ann an ro-ràdh a’ Phàipear Comhairleachaidh tha e air a ràdh gu bheil 24 mìos aig a’ Bhòrd gus Plana a dhealbh agus a chur gu Ministearan. Tha mì-chinnt eadar an dà aithris a dh’fheumas a shoillearachadh.

C4: Am bu chòir na h-ùghdarrasan ann am pàipear-taice 1, Paragraf 11 den dreach Bhile a bhith air an toirt do Bhòrd na Gàidhlig?

Tha sinn ga mheas iomchaidh gum biodh na cumhachdan ann am Pàipear-taice 1, Earrann 11 den dreach Bhile air a bhith air an toirt do Bhòrd na Gàidhlig gus am bi e comasach dhaibh an dleastanasan an coilionadh.

C5: A bheil nithean eile seach na tha an earrann 5(5) den dreach Bhile, dham bu chòir buidhnean poblach aire a thoirt ann an co-dhùnadh am bu chòir dhaibh Plana Cànain Gàidhlig ullachadh?

Feumar atharrachadh a dhèanamh air Earrann 5(5) den Dreach Bhile oir chan eil na h-uallachaidhean (a) agus (b) gam meas mar shlatan-tomhais reusanta do bhuidhnean poblach a bhith a cleachdadh nuair a bhios iad a’ beachdachadh air dè cho iomchaidh sa tha e Plana Cànain a bhith aca.

Tha sinn a’ moladh gu làidir gum bu chòir e a bhith mar fhiachaibh air gach buidheann poblach ris a bheil Pàipear Taice 2 a’ buntainn, Plana Cànain Gàidhlig ullachadh agus a chur an gnìomh, chan ann mar a tha am Bile an dràsta, far am bheil buidhnean poblach iad fhèin a’ meas a bheil e iomchaidh dhaibh Plana a dhealbh. A thuilleadh air a sin, chan eil sinn ga mheas mar shlat-tomhais fheumail gum feum buidhnean poblach beachdachadh air an ìre gu bheil a’ Ghàidhlig air a cleachdadh leis na daoine ris am bheil gnìomhachas na buidhne a’ buntainn agus an ceangal a tha eadar a’ Ghàidhlig agus an gnìomhachais sin. Bhiodh e nas riatanaiche gu feumadh a’ bhuidheann phoblach coimhead ris an ìre gu bheil an cànan ga cleachdadh san sgìre sa bheil a’ bhuidheann stèidhichte agus ag obair. An uairsin bhiodh e an urra ris a’ bhuidheann phoblach, le comhairle bho Bòrd na Gàidhlig, co-dhùnadh a dhèanamh air an ìre aig am bi Gàidhlig a’ nochdadh ann an obair làitheil na buidhne. Bu chòir Plana Cànain na buidhne a bhith a-rèir an gnìomhachais, a-rèir na sgìre a tha iad a’ seirbheiseachadh agus a bhith a’ gabhail a-staigh neart agus ùidh ann an Gàidhlig san sgìre.

Bu chòir roinnean Riaghaltas Whitehall ag obair ann an Alba a bhith air an gabhail a-staigh do Phàipear Taic 2 mar buidhnean poblach a dh’fheumas beachdachadh air Plana Cànan; m.e. Roinn Obrach is Peinnsean, Roinn nan Cìsean, Ionadan Obrach ‘s mar sin air adhart. Tha buidhnean sònraichte nach eil a’ nochdadh ann am Pàipear Taice 2 m.e. COSLA, Cùirt an Fhearainn, Comhairlean Slàinte, Caledonian Mac a’ Bhruthainn, Puirt Adhair na Gaidhealtachd ’s nan Eilean, Colaistean Foghlam Àrd Ìre, Oilthighean agus feuman poblach. Tha còir cuideachd a bhith a’ beachdachadh air ciamar a b’urrainn buidhnean poblach ionadail ann an coimhearsnachdan Gàidhlig, mar Urras Steòrnabhaigh, a bhith air an gabhail a-staigh fo Pàipear Taic 2 den Bhile. Tha e beagan annasach, cuideachd, nach eil iomradh idir air Seirbheis nam Meadhanan Gàidhlig, am buidheann a tha a’ gabhail dleastanasan Comataidh Craolaidh Gàidhlig os làimh bhon 29mh den Dùbhlachd 2003, bho Achd Conaltraidh 2003.

C6: Am bu chòir riatanas a chur air buidhnean poblach a bhith a’ beachdachadh a bheil e iomchaidh plana-cànain Gàidhlig ullachadh agus fhoillseachadh a’ mhìneachadh am poileasaidhean agus nan seirbheisean a bhios iad a’ tabhann sa Ghàidhlig?

Mar a chaidh a ràdh aig freagairt C5 tha sinn teagmhach mu dè cho èifeachdach sa bhiodh am Bile an-dràsta le bhith ag iarraidh air buidhnean poblach a bhith a mhàin “co-dhùnadh le spèis do na nithean air an ainmeachadh ann am fo-earrann (5) a bheil e iomchaidh plana-cànain Gàidhlig ullachadh agus fhoillseachadh”.

Bhiodh an suidheachadh nas èifeachdaiche nam biodh e na riatanas reachdail air buidhnean poblach Plana no Sgeamaichean Cànain ullachadh agus fhoillseachadh nuair a dh’ iarraidh Bòrd na Gàidhlig sin a dhèanamh. Bhiodh seo a’ ciallachadh gum biodh Bòrd na Gàidhlig a’ dèanamh an iomairt agus ag obair le buidhnean poblach gan stiùireadh agus gan comhairleachadh. Cuideachd, leigeadh seo le Bòrd na Gàidhlig clàr-ama a chruthachadh dhaibh fhèin airson Planaichean Cànain fhaighinn bho bhuidhnean poblach. Ma dh’ fheumas na buidhnean poblach a tha comharraichte planaichean ullachadh taobh a-staigh dà bhliadhna bhon àm a thig am Bile gu lagh bidh seo a’ fàgail Bòrd na Gàidhlig le eadar 150 - 200 Plana Gàidhlig. Bhiodh e do-dhèanta don Bhòrd dèiligeadh ris an uallach sin ann an dà bhliadhna gun mòran a bharrachd luchd-obrach agus maoineachaidh.

C7: Am bu chòir don Bhile dleastanas a chur air Bòrd na Gàidhlig a bhith a’ cuideachadh agus a’ comhairleachadh bhuidhnean poblach ann an ullachadh planaichean-cànain Gàidhlig?

Tha e deatamach gum bi ùghdarras aig Bòrd na Gàidhlig chan ann a-mhàin airson comhairle agus stiùireadh a thoirt do na buidhnean poblach le bhith ag ullachadh Planaichean Cànain, ach cuideachd airson cinnt a dhèanamh gun tèid na planaichean an cur an gnìomh. Tha ceist oirnn am bheil e riatanach gu feumadh stiùireadh a chaidh fhoillseachadh le Bòrd na Gàidhlig a bhith air aontachadh an toiseach le Ministearan. Ma gheibh am Plana Nàiseanta aig Bòrd na Gàidhlig aonta bho na Ministearan cha bu chòir gum biodh feum sam bith air aonta a bharrachd fhaighinn do stiùireadh a dh’ ullaicheadh am Bòrd do bhuidhnean poblach oir bhiodh sin a-rèir na bhiodh sgrìobhte sa Phlana Nàiseanta.

C8: Am bu chòir don Bhile riatanas a chur air Bòrd na Gàidhlig a bhith ag ullachadh stiùireadh mu planadh cànain Gàidhlig?

Gus cinnt a dhèanamh gum bi seasmhachd nàiseanta ann am planadh cànain Gàidhlig tha e deatamach gum faigh Bòrd na Gàidhlig ùghdarras sa Bhile gus stiùireadh Nàiseanta ullachadh mu choinneamh planadh cànain Gàidhlig. Ach mar a chaidh a ràdh mar thà, feumaidh sinn ceist a thogail am bheil e deatamach no riatanach gu feumadh Bòrd na Gàidhlig aonta fhaighinn bho na Ministearan mu choinneimh an stiùiridh seo. Shaoileadh gum fòghnadh aonta fhaighinn bho na Ministearan air a’ Phlana Nàiseanta gus leigeil le Bòrd na Gàidhlig a bhith a’ dol air adhart le bith a’ toirt stiùiridh agus comhairle do na buidhnean poblach. Bhon a bhiodh ùghdarras aig Bòrd na Gàidhlig comhairle agus stiùireadh a thoirt do na buidhnean poblach mu choinneimh am planaichean cànain tha e riatanach gum biodh an aon ùghdarras aca stiùireadh a thoirt do dh’ ùghdarrasan ionadail air Foghlam tro Mheadhan na Gàidhlig. Ach tha sinn làidir den bheachd gum biodh àrd-amas nan coimhearsnachdan Gàidhlig, a thàinig gu follais aig àm a’ chonaltraidh a rinneadh mus deach molaidhean ChNAG air Inbhe Thèarainte fhoillseachadh, gun deidheadh gealladh làidir fhaighinn, ceangailte ann an lagh, a bheireadh còir do phàrantan air Foghlam tro Mheadhan na Gàidhlig far am biodh iarrtas reusanta (bha CNAG a’ meas seo aig 5 sgoilear aig an àm). Tha sinn gu làidir den bheachd gur e seo fhathast beachd agus rùn nan coimhearsnachdan Gàidhlig ann an Alba, agus tha sinn a’ moladh gum bu chòir seo a thoirt a-staigh dhan ath-dhreach den Bhile.

C9: Am bu chòir dleastanas a bhith aig Bòrd na Gàidhlig ann an comhairleachadh ùghdarrasan foghlaim agus Riaghaltas na h-Alba mu phlanaichean airson Foghlam meadhan-Gàidhlig a’ sruthadh bho Achd 2000?

Tha e mar fhear de dhleastanasan Bòrd na Gàidhlig cinnt a dhèanamh gum mair an cànan beò le bhith ag àrdachadh àireamhan luchd-labhairt agus tha foghlam Gàidhlig aig a h-uile ìre bunaiteach ann a bhith a’ toirt an amas sin gu buil. Chan eil na h-ullachaidhean a rinneadh fo Achd Ìrean Sgoiltean Alba 2000 air a bhith èifeachdach gu leòr gu bhith a’ toirt gu buil na geallaidhean a rinn an Riaghaltas aig an àm nuair a rinneadh iomairt atharrachadh a dhèanamh ris an Achd gus còirichean nas làidire a thoirt do phàrantan a bha a’ sireadh foghlam Gàidhlig. Bho nach eil dearbhadh sam bith gu bheil an Achd 2000 air àrdachadh sònraichte a thoirt air Foghlam tro Mheadhan na Gàidhlig ann an Alba, tha sinn ag iarraidh gun tèid atharrachadh a dhèanamh anns a’ Bhile seo gus còir phàrantan air Foghlam tro Mheadhan na Gàidhlig a thoirt gu ìre a-rèir molaidhean CnaG ann an 1999. Seach nach eil Achd 2000 a’ toirt a-steach ach foghlam foirmeil a-mhàin, chan eil na raointean cudromach mar foghlaim fo aois sgoile, coimhearsnachd, no foghlaim àrd ìre a’ tighinn fon Achd no fon Bhile. Mar sin feumar dèanamh cinnteach gun tèid iomradh a thoirt air na leasachaidhean agus taic don Ghàidhlig anns na raointean sin, agus cha ghabh sin dèanamh ach tron Bhile. Tha ùghdarrasan ionadail fhèin air aideachadh nach eil Achd 2000 air Inbhe Foghlam tro Mheadhan na Gàidhlig àrdachadh ann an dòigh sam bith. Tha e nise follaiseach, nar beachdsa, nach tig àrdachadh sònraichte air àireamhan luchd-labhairt na Gàidhlig ach a-mhàin le gealladh bhon Riaghaltas gun tèid Gàidhlig a ghabhail a-staigh do prìomh chlàr-oideachaidh na sgoile aig ìre bun-sgoile agus àrd-sgoile. Ach, tha seo air fhaicinn mar amas fhad-ùine agus bhiodh feum air luchd-teagaisg gu leòr fhastadh agus an trèanadh mus tig seo gu buil. Cha bhiodh èifeachd sam bith ann dleastanas comhairleachaidh a bhith aig a’ Bhòrd air cuspairean foghlaim mur a biodh cumhachd aca dha rèir.

C10: A bheil sibh airson beachd a thoirt air nithean sam bith eile ann an dreach Bhile na Gàidhlig?

Tha Comunn na Gàidhlig a’ cur fàilte air Bile na Gàidhlig agus air rùn an Riaghaltais gus “Bile Gàidhlig a lìbhrigeadh a choileanas amasan coimhearsnachd na Gàidhlig.” Ach airson na h-adhbharan gu h-àrd tha e soilleir nach eil na tha anns a’ chiad dreach den Bhile seo a’ coilionadh iarrtasan agus feumalachdan coimhearsnachd na Gàidhlig mar a bha e air fhoillseachadh aig àm conaltraidh Bile na Gàidhlig (a ghabh a-staigh athchuinge le 10,000 ainm) nuair a chuir Comunn na Gàidhlig na molaidhean ri chèile ann an 1999. Chan eil dearbhadh sam bith againn gu bheil beachdan coimhearsnachd na Gàidhlig air atharrachadh bhon uairsin. Gu dearbh, a-rèir nam beachdan làidir a nochd aig an t-sreath choinneamhan poblach a chumadh bho chionn ghoirid air feadh Alba, tha coimhearsnachd na Gàidhlig gu daingeann nam beachd gu bheil deagh thaic agus buntainneas fhathast aig molaidhean Comunn na Gàidhlig bho 1999.

Dh’ fheumadh Bòrd na Gàidhlig barrachd ghoireasan fhaighinn gus am biodh e comasach dhaibh na dleastanasan a bhios dùil a chur orra fon Achd a choilionadh. Thug Aithisg Buidheann Comhairleachaidh an Riaghaltais air Gàidhlig, iomradh air na goireasan sin agus dh’ fheumadh an Riaghaltas beachdachadh orra nuair a bhios iad a’ cur an gnìomh ullachaidhean Achd na Gàidhlig. Tha feum aig Bòrd na Gàidhlig làn thaic fhaighinn bho Riaghaltas na h-Alba, còmhla ri taic bho bhuidhnean poblach agus buidhnean Gàidhlig air feadh Alba gus cinnt a dhèanamh gun tèid ullaichidhean airson Achd Ghàidhlig làidir an cur an gnìomh. Chan urrainn seo a dhèanamh ach mar a leanas:

  1. Gàidhlig aithneachadh an co-ionnanachd le Beurla gus a mhì-chinnt a tha ann an inntinn cuid de dhaoine agus de bhuidhnean poblach mu choinneimh inbhe reachdail na Gàidhlig ann an Alba a chuir an dàrna taobh. Gus inbhe na cànain a mhìneachadh ann an Alba gu tur dh’ fheumadh aithrisean nam Ministearan air a’ chuspair seo an daingneachadh ann an reachdas.
  2. a bhith a’ gabhail a-staigh don Achd còirichean phàrantan agus luchd cleachdadh na Gàidhlig mu choinneimh a bhith a’ cleachdadh Gàidhlig nan dèiligeadh ri buidhnean poblach agus ri ùghdarrasan foghlaim airson Foghlam tro Mheadhan na Gàidhlig fhaighinn; agus
  3. cumhachdan iomchaidh a thoirt do Bhòrd na Gàidhlig gus a dhèanamh cinnteach gun ullaich buidhnean poblach Planaichean Gàidhlig agus gun tèid an coileanadh.

Tha sinn cuideachd draghail nach eil iomradh shònraichte ga thoirt mu choinneimh chòirichean dhaoine a tha nochdadh ann an Cùirt (an dà chuid eucoir agus sìobhalta, mòd-ceartais agus a h-uile buidheann breitheach no cuasai-bhreitheach) gus fianais a thoirt tro mheadhan na Gàidhlig. Tha bheag no mhòr de chòir ann an-dràsta, fo Chùmhnant Eòrpach nam Mion Chànan, airson cùisean sìobhalta ann an Steòrnabhagh, Loch nam Madadh agus Port Rìgh, ach dh’ fheumar seo a leudachadh a-mach gu cùirtean air feadh Alba.

Dh’ fheumadh an reachdas gu lèir a thaobh clàradh ainmean, laghan thaghaidhean, laghan co-cheangailte ri riaghladh bhuidhnean, stèidheachadh chathrannais, urrasan, tighearnais agus pàirteachaidh atharrachadh gus ainmean agus mìneachadh Gàidhlig a ghabhail a-staigh. Thathas a’ moladh cuideachd gun dreachadh atharrachadh a thoirt air an Achd Dàimh Chinnidh agus air an Achd Òrdugh Poblach gus dèanamh cinnteach gu bheil còirichean nan Gaidheal agus luchd-labhairt na Gàidhlig air an glèidheadh fon reachdas mar a tha còirichean mion-bhuidhnean eile.

Feumar coimhead ri maoineachadh Craoladh Gàidhlig. Ged a tha an reachdas airson craoladh, a’ gabhail a-staigh craoladh Gàidhlig, aig Riaghaltas Lunnainn, tha suidheachadh neo-àbhaisteach ann far am bheil maoineachadh craoladh Gàidhlig an urra ri Riaghaltas na h-Alba. Dh’ fheumadh dòigh maoineachaidh, a-rèir mar a tha aig S4C sa Chuimrigh a stèidheachadh mar chùis-èiginneach.

Mu dheireadh, thathas a’ moladh gun gabh an Riaghaltas ceumannan far am biodh e an urra ris a’ Chomataidh iomchaidh, mar eisimpleir Comataidh Co-ionnanachd Chothroman, sgrùdadh a dhèanamh air gach reachdas a tha a’ Phàrlamaid a’ moladh gus dearbhadh a dhèanamh gu bheil aire ga thoirt don bhuntainneas a tha aig a’ Ghàidhlig agus a cultar air gach Bile.

CnaG Submission on the Draft Gaelic Language Bill

INTRODUCTION

Comunn na Gàidhlig (CnaG) welcomes the opportunity to respond to the Consultation process on the Draft Gaelic Language Bill and hopes that the following comments will assist the Executive in producing a revised version of the Bill, which will reflect the views expressed by CnaG and other respondents.

While the timescale for the consultation process has not been a problem for CnaG, we are aware that the Autumn holiday period in October and the Christmas and New Year period may have caused problems for some respondents, and concerns have been raised that the timescale was a bit tight. We hope that any respondent who requires more time to submit their views will be given an extension to the deadline of 9 January 2004.

We would be happy to be given the opportunity to expand and amplify the points made in our submission at any future hearing held by the Committee, which will be scrutinising the Bill. We would also invite the Committee to undertake a series of visits to appropriate places in Scotland in order to gain a closer understanding of the position of the Gaelic language and culture, in a range of different communities, throughout Scotland.

Q1: Is it right that Gaelic be recognised as one of the languages of Scotland in statute?

The wording of the Bill falls far short of CnaG’s Inbhe Thèarainte proposals, which states that “any Gaelic Language Act should begin with an expression of the principle of equal validity for Gaelic and English in Scotland”. This principle implies certain basic rights with respect to Gaelic medium services to all users of the Gaelic language. The Bill should specifically state that Gaelic is an official language in Scotland and will, in principle, be treated equally with English in the conduct of public business. We are strongly of the view that the wording in the Bill should be amended to follow the wording of the Welsh Language Act 1993. This would, in the case of Gaelic, underline the principle that so far as is appropriate and practicable, Gaelic and English will be treated on the basis of equality.

Unless the opportunity is taken to clarify what precisely is meant in the Bill by “securing the status of the Gaelic language as one of the languages of Scotland”, confusion and uncertainty will continue to prevail. Government Ministers at both Westminster and Edinburgh have indicated, on previous occasions, that Gaelic is already officially recognised by successive Governments. This view was stated in a House of Lords debate on broadcasting in Summer 2003, by a Minister at the Department of Culture, Media and Sport, Lord Evans of Temple Guiting. If this is the case, then there should be no objection to consolidating Ministerial statements in legislation, through the Bill, in order to avoid problems such as those which arose earlier this year, with the Registrar General for Scotland when, initially, the request of a parent to register a child with a Gaelic surname was refused.

Q2: Should Bòrd na Gàidhlig have the functions provided in Section 1 of the draft Bill?

Bòrd na Gàidhlig should have the functions specified in Section 1 of the Draft Bill, but consideration needs to be given to including those who are able to read or write Gaelic, in addition to those who are able to speak or understand the Gaelic language. No mention is made of the rights of parents to Gaelic medium education or users of the language and this should be incorporated within the functions of Bòrd na Gàidhlig.

Q3: Should the requirements in sections 2 and 3 of the draft Bill be placed on Bòrd na Gàidhlig?

We agree that the requirement in Section 2 and Section 3 of the Draft Bill should be placed on Bòrd na Gàidhlig in relation to the preparation of National Gaelic Language Plans and in preparing guidance for public bodies in establishing their own Language Plans. However, clarification is required on the timescale required by Bòrd na Gàidhlig for preparing the National Gaelic Language Plan. The Bill itself requires Bòrd na Gàidhlig to prepare and submit to Scottish Ministers a National Gaelic Language Plan within 12 months of the commencement of Section 2 of the Act. However, in the pre-amble to the Consultation Document, there is a suggestion that the Bòrd has 24 months in which to prepare and submit to Ministers, for approval, a Plan for Gaelic. There seems to be a contradiction in these two statements.

Q4: Should Bòrd na Gàidhlig be given the powers in schedule 1, paragraph 11 to the Bill?

The powers in Schedule 1, paragraph 11 to the Draft Bill would appear to be appropriate and relevant to enable the Bòrd to carry out its general functions. However, it is essential that adequate resources are made available to the Bòrd to enable it to undertake its functions effectively.

Q5: Are there other matters beyond those in section 5(5) of the draft Bill that public bodies should have regard to in determining whether to prepare a Gaelic language plan?

Section 5(5) of the Draft Bill requires to be amended since provisions (a) and (b) are not considered to be sufficient criteria which public bodies should use to determine whether to prepare a Gaelic Language Plan.

We would strongly urge that it should be a requirement on all public bodies specified in Schedule 2 of the Act to prepare and implement a Gaelic Language Plan, rather than the current provisions which merely require public bodies to determine whether it is appropriate for them to adopt such Plans. Furthermore, a requirement by the public body to determine the extent to which persons in relation to the public body’s functions are exercisable to use the Gaelic language is not considered to be a logical or meaningful criterion. It would be more appropriate to require the public body to take account of the extent to which the language is used within the location and area served by the body. It would then be up to the public body, in consultation with Bòrd na Gàidhlig, to determine the extent to which Gaelic should be reflected in the day to day operations of the public body. Language Plans prepared by the public bodies should be appropriate to their functions and to the area served by them and take account of the strength and interest of the Gaelic language within their areas of operation.

Public bodies specified in Schedule 2 should also include all Whitehall administrative arms of Central Government active in Scotland, such as the Dept of Work and Pensions, Inland Revenue, Job Centres etc. There are also some notable omissions to the list at Schedule 2 e.g. COSLA, Land Court, Local Health Councils, Caledonian MacBrayne, Highlands & Islands Airports, Careers Scotland, Further Education Colleges, Universities and public utilities. There is also a need to consider a method under which local public bodies operating in a strong language community such as The Stornoway Trust, for example, could be taken under the scope of Schedule 2. A rather curious omission from the list is the Gaelic Media Service, which comes into force on 29 December 2003 and takes over Gaelic broadcasting responsibilities from the Gaelic Broadcasting Committee, under the provisions of the Communications Act 2003.

Q6: Should public bodies be required to consider whether it is appropriate to prepare and publish a Gaelic language plan describing the services they will offer in Gaelic?

As mentioned in the response to Q5 we question the effectiveness of the current requirement in the Bill on public bodies merely to “determine, having regard to the matters mentioned in Sub-Section 5, whether it is appropriate to prepare and publish a Gaelic Language Plan”.

A more positive and effective approach would be a statutory requirement on public bodies to publish and prepare their Language Plans (or should they be called Schemes?), following invitation from Bòrd na Gàidhlig to do so. This would have the effect of Bòrd na Gàidhlig taking the initiative in a proactive way and acting in an advisory and consultancy role to the public bodies in the preparation and contents of their Plans. It would also enable Bòrd na Gàidhlig to determine its own timescale in seeking Language Plans from public bodies. To require the specified public bodies to prepare plans within two years of the Act becoming law will inevitably result in Bòrd na Gàidhlig being inundated with anything between 150-200 Gaelic Language Plans. The practicalities and the ability of Bòrd na Gàidhlig to deal with such a workload, within a two year period without considerable additional resources, is questionable.

Q7: Should the Bill provide for Bòrd na Gàidhlig to assist and advise public bodies in the preparation of Gaelic language plans?

It is essential that Bòrd na Gàidhlig has the powers not only to assist and advise public bodies in the preparation of Gaelic Language Plans, but also powers to ensure implementation of the Plans. We must question whether it is necessary for guidance issued by Bòrd na Gàidhlig to be approved, in advance, by Ministers. If Ministerial approval is given to Bòrd na Gàidhlig’s National Plan for Gaelic, there should be no further need for Ministerial approval for any guidance prepared by the Bòrd, for public bodies, since the guidance should, in any event, be drawn up in accordance with the contents of the National Plan.

Q8: Should the Bill require Bòrd na Gàidhlig to prepare guidance on Gaelic language planning?

In order to ensure national consistency in Gaelic language planning it is essential that Bòrd na Gàidhlig is given the powers in the Bill to prepare National Guidelines on Gaelic language planning. However, as previously mentioned, we need to query whether it is essential and necessary for Bòrd na Gàidhlig to seek Ministerial approval for such guidance. One would expect that approval of the National Gaelic Language Plan by Ministers would be sufficient to enable Bòrd na Gàidhlig to take the necessary action and provide adequate advice to public bodies flowing from the approval of the National Gaelic Language Plan. In line with Bòrd na Gàidhlig’s powers to advise public bodies on their respective Gaelic Plans through those guidance statements, it is logical for the Bòrd to also have similar powers in relation to local authorities for the provision of Gaelic Medium Education. We are strongly of the view, however, that the aspirations of the Gaelic communities, as enunciated strongly in the consultation process which preceded CnaG’s Secure Status proposals, was to seek a strong commitment, embedded in legislation, to give parents the right to obtain Gaelic Medium Education where a reasonable number of requests (defined by CnaG at the time as 5 pupils) for admission to Gaelic Medium Education had been received. We believe that this aspiration is still strongly supported by the Gaelic communities throughout Scotland and we urge that this matter be addressed fully in the next version of the Bill.

Q9: Should Bòrd na Gàidhlig have a role in advising education authorities and the Scottish Executive on plans for Gaelic medium education flowing from the 2000 Act?

One of the functions of Bòrd na Gàidhlig is to ensure the survival of the language through an increase in the number of Gaelic speakers. Gaelic education at all levels is central in pursuing this aim. The current provisions under the Standards in Scotland’s Schools etc Act 2000 have, so far, failed to live up to the promise given at the time by the Executive when attempts were made to amend the Act to provide a stronger commitment in relation to parental rights for Gaelic education. In the absence of any concrete evidence that the 2000 Act has significantly increased Gaelic Medium Education provision throughout Scotland, we must ask that the provisions of this Bill be amended to include the rights of parents for Gaelic Medium Education in accordance with Comunn na Gàidhlig’s 1999 proposals. Local Authorities themselves have admitted that the 2000 Act has not enhanced the position of Gaelic Medium Education in any meaningful way. Since the scope of the 2000 Act is restricted to statutory education, the important sectors of pre-school, community, further and higher education is not, at present, covered either by the 2000 Act or the Gaelic Bill. It is essential that provision be made for the development and support of Gaelic in these sectors and this can only be done through the Bill. It is now clear, in our view, that any significant improvement in increasing the numbers of Gaelic speakers can only be done through a firm commitment by the Executive to include Gaelic as one of the subjects within the core curriculum at primary and secondary school levels. However, this is regarded as a long-term aim, and will require the recruitment and training of adequate teachers, before this aspiration can be met. An advisory role for the Bòrd, on education matters, without more specific monitoring and implementation powers, is unlikely to be very effective in fulfilling Bòrd na Gàidhlig’s functions in increasing the number of Gaelic speakers, since this can only be done with the full support of education authorities and other providers of Gaelic education.

Q10: Would you like to comment on any other aspects of the draft Gaelic Language Bill?

Comunn na Gàidhlig welcomes the publication of the Gaelic Language Bill and the Executive’s commitment to “provide a Gaelic Language Act which will meet the aspirations of the Gaelic community”. However, for the reasons outlined above, it is clear that the provisions within this first draft of the Bill fall far short of the aspirations of the Gaelic community as evidenced through the consultation process (which included a petition of 10,000 signatures) when Comunn na Gàidhlig formulated it’s proposals in 1999. We have no evidence to suggest that the views of the Gaelic community have changed in any way since 1999. In fact, based on the strong views which have been expressed at the recent series of public meetings throughout Scotland, it is obvious that the Gaelic community is as resolute as ever that the proposals contained in CnaG’s proposals of 1999 are still relevant and strongly supported.

  1. the Gaelic language being specified as having equal validity with English, where appropriate, practicable and reasonable, in order to remove the confusion that continues to exist in the minds of many public bodies and individuals in relation to the legal and official status of Gaelic within Scotland. All that is required is to consolidate previous Ministerial announcements to this effect in legislation, in order to clarify the status of the language, within Scotland, once and for all.
  2. inclusion in the Act of the rights of parents and Gaelic users in relation to the use of Gaelic in their dealings with public bodies, including education authorities and other providers for the provision of Gaelic Medium Education at all levels; and
  3. adequate powers being provided to Bòrd na Gàidhlig to ensure that public bodies prepare and implement the provisions of their Gaelic Language Plans.

We are also concerned that there is no specific provision in relation to the rights of people appearing before all Courts of General Jurisdiction (both criminal and civil, administrative tribunals and all other judicial or quasi-judicial bodies) to present cases and give evidence through the medium of Gaelic. Limited provision already exists under the European Charter for Regional and Minority Languages in relation to civil cases in Stornoway, Lochmaddy and Portree, but this requires to be extended to all courts within Scotland.

All legislation relating to the registration of personal names, all election laws, laws relating to regulation and corporation of companies, the establishment of charities, trusts, proprietorships and partnerships, should be amended to allow for the use of Gaelic names and descriptions. It is further recommended that changes to the Race Relations Act and the Public Order Act are considered to ensure that Gaels and Gaelic speakers have the same protection under these measures of legislation as other minorities.

The funding of Gaelic Broadcasting needs to be addressed. Although legislation for broadcasting, including Gaelic broadcasting, is a reserved power and within the province of the Westminster Parliament the anomaly exists, since the Scotland Act, whereby the Scottish Parliament is responsible for funding Gaelic broadcasting. An agreed funding formula, along the lines of S4C in Wales, needs to be addressed, as a matter of urgency. Consideration should be given to making the necessary provision for the funding of Gaelic Broadcasting within the Gaelic Bill.

Finally, it is suggested that the Executive introduce measures that would require the relevant Committee of the Parliament, such as the Equal Opportunities Committee, to scrutinise all legislation being approved by Parliament, to ensure that the relevance of the Gaelic language and culture to each Bill being proposed by the Parliament, is considered.
